Terms of Use

Please read these Terms of Use carefully before using Dedicated Hostings services. These terms govern your use of our website and all hosting services provided by Dedicated Hostings, Inc.

1. Acceptance of Terms

  • By accessing or using Dedicated Hostings services, you agree to be bound by these Terms of Use.
  • If you do not agree to these terms, you may not use our services.
  • We reserve the right to modify these terms at any time. Continued use of our services after modifications constitutes acceptance.
  • These Terms of Use constitute a legally binding agreement between you and Dedicated Hostings, Inc.

2. Services

  • Dedicated Hostings provides dedicated server hosting, VPS hosting, and related infrastructure services.
  • Services are provided on a month-to-month basis unless otherwise specified in your service agreement.
  • We reserve the right to modify, suspend, or discontinue any service with reasonable notice.
  • Service specifications (CPU, RAM, storage, bandwidth) are as described at the time of order and may be subject to change with notice.

3. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized access to your account.
  • You must provide accurate and complete information when creating your account.
  • Accounts may not be transferred or sold to third parties without written consent.

4. Acceptable Use Policy

  • You may not use our services for any illegal activities or to violate any applicable laws.
  • Prohibited activities include: distributing malware, conducting DDoS attacks, sending unsolicited bulk email (spam), hosting child exploitation material, copyright infringement, and phishing.
  • You may not use our services to interfere with, disrupt, or compromise the security of any network or system.
  • Excessive bandwidth or resource usage that impacts other customers may result in throttling or account suspension.
  • We reserve the right to suspend or terminate accounts found in violation of this policy without prior notice.

5. Payment Terms

  • Services are billed monthly in advance unless otherwise agreed.
  • Payment is due on or before the invoice due date.
  • Accounts with overdue balances may be suspended after 5 days and terminated after 15 days of non-payment.
  • All fees are non-refundable except as specified in our refund policy.
  • We reserve the right to change pricing with 30 days advance notice.

6. Refund Policy

  • New accounts are eligible for a pro-rated refund within the first 7 days if cancelled for any reason.
  • After the initial 7-day period, no refunds are provided for cancellations.
  • Setup fees, domain registrations, and IP address allocations are non-refundable.
  • Accounts terminated for violations of these Terms of Use are not eligible for refunds.

7. Service Level Agreement

  • Dedicated Hostings guarantees 99.99% network uptime for all services.
  • Scheduled maintenance windows will be communicated at least 48 hours in advance.
  • In the event of downtime exceeding our SLA, customers will receive service credits upon request.
  • SLA credits are calculated as: (Downtime minutes / 43,200) × monthly service fee.
  • Force majeure events, customer-caused outages, and scheduled maintenance are excluded from SLA calculations.

8. Data and Backups

  • You are solely responsible for maintaining backups of your data and content.
  • Dedicated Hostings does not guarantee data backup or recovery unless a managed backup service is purchased.
  • We recommend maintaining off-server backups of all critical data at all times.
  • In the event of data loss, Dedicated Hostings liability is limited to providing the service credit specified in our SLA.

9. Intellectual Property

  • All content on the Dedicated Hostings website, including logos, trademarks, and marketing materials, is owned by Dedicated Hostings, Inc.
  • You may not use our trademarks or copyrighted materials without written permission.
  • You retain ownership of all content and data you store on our servers.
  • By using our services, you grant us a limited license to process and store your data solely for the purpose of providing the services.

10. Limitation of Liability

  • Dedicated Hostings liability is limited to the monthly fees paid for the affected service.
  • We are not liable for indirect, incidental, special, or consequential damages.
  • We are not responsible for data loss, lost profits, or business interruption.
  • Some jurisdictions do not allow limitations of liability, so these limitations may not apply to you.

11. Termination

  • You may cancel your service at any time through the Client Area or by contacting support.
  • We reserve the right to terminate accounts that violate these Terms of Use.
  • Upon termination, your data will be securely deleted within 30 days unless retrieval is requested within 7 days.
  • Termination does not relieve you of any payment obligations for services already rendered.

12. Governing Law

  • These Terms of Use are governed by the laws of the State of Texas, United States.
  • Any disputes arising under these terms shall be resolved in the courts of Dallas County, Texas.
  • You consent to the personal jurisdiction and venue of courts in Dallas County, Texas.
